Complacency: Zeros & Ones of Safety...

How might you increase your own resilience to known potential risks in your business operations or even personally this week, or this month?

We all know that growing up, Mom and Dad would teach us, “Don’t talk to strangers”. “Don’t play with matches”. “Wear your seat belt”. Why?

Even a U.S. President is famous for his quote: “Trust But Verify”.

Our life long history of financial transactions and your own personal biometric identity, has made its way online and into the Zeros and Ones digital realms of the U.S. government, Google, Amazon, Apple, Nordstroms and even Netflix.

The single phone number and the e-mail address you have retained for a decade or more, tells almost your entire life story. Where, What, When. How.

In the years past, as you were experiencing all the new mobile technologies and digital services available to you, remember that so too, are the “Nation States” and the “International Criminal Syndicates.

You, the “Human Being” operator, are the single greatest risk to your business and your family safety.

Cultural Cognition: The Velocity of our Future…

In the culture that you are part of, there are Trust Decisions being made in seconds based upon rules.  Yet your particular culture has evolved over time, also because of the affinity that your culture attracts other people, just like you.

The question is, who do you really aspire to be?

The 3rd Planet: On The Edge of a Digital Precipice...

After reading the Washington Post on February 3, 2018, there is little debate in our world capitals, that we are on the edge of a digital precipice.

Mobile devices in the hands of humans, has exponentially changed the transnational landscape for our communications forever.  Yet this digital precipice is just inches away from a tremendous chasm in our cultural, social and legal way of life.

Every organization, now has substantial Operational Risks to manage, within the context of their group, company, enterprise, government and even family.  This alone is not a revelation.  However, if you are a Mother, Father, Brother or Sister, you are constantly challenged by the kinds of risks that plague anyone who dares to explore and utilize the benefits of the modern day Internet.

Our children are growing up faster, as they are exposed to the dark side of life, the evil that is present in our world.  They witness violence, revenge and all of the other negative attributes of society faster than ever before.

The outcomes of mother nature and our natural disasters are always front and center.  The digital controls and censors of broadcast television are no longer pervasive across the content and web sites available, to those who know how to navigate our IP-based digital oceans.

Operational Risk Management (ORM) is now each persons responsibility.  It is no longer in the hands of a few people, in a few departments at your organization.  It is not the role of a single person in your household, to make sure the family router is configured correctly.

If you are holding your latest "Digital Device" in your hand, or tapping away on the keyboard of your new lap top it is your decision to "Give" or to "Take."

Over a year ago, Adam Grant wrote his book.  To get some context in 13 minutes, you can watch this YouTube of his Ted Talk.

We have for years been exposed to the concepts of "Pay It Forward" or even other concepts of reciprocity.  The real question is:  Are you a "Giver or a Taker?"  You might be surprised to learn what Adam Grant's research uncovers.

So what?

The ethics and morals that are embedded in you at an early stage of your life, will most likely continue.  The influence your Mother and/or Father or early childhood caregiver provided you may have made a difference.  Maybe it was an old book they read to you, or someone asked you to read.

We all know that the words, content, pictures, videos and ideas on the other side of that tiny digital screen in your hand, is nothing more than a mirror, of our own human behavior.  Good or deleterious.

How will you use this iPhone tool today, to be a "Giver or a Taker?"  There might even be another option.  Turn it off and put it in a drawer.  At least for a few hours...but could you for a whole day?

When was the last time you donated your time, expertise, abilities or resources?  What will you do right now, to make a difference on the third planet from the Sun...

Legal Risk: Forensic Analysis of Supply Chain...

Corporate environments where a dedicated Chief Information Security Officer (CISO) works along side the General Counsel (GC) to tackle Operational Risk Management (ORM), continues to be a significant challenge.  The introduction of court certified tools for forensic analysis of information on both desktop and mobile devices to include phones, tablets and anything with a storage capability (USB Jump Drives) has created an executive level debate.  "What" information will we perform forensic analysis on, "why" and "when" will we do it?

The "Why" question is most obvious, like the analysis of DNA, the zeros and ones (0's and 1's) that make up the digital fingerprints (user names, passwords), blood-type (e-mail, SMS) and other behavioral evidence is important to associate the identity of the person(s) using a certain digital device. In addition, the ability to track the whereabouts of a particular digital device via GPS metadata or IP address, can also provide additional context and evidence, to be considered in the forensic examination.

The "What" information is in many cases going to be preceded by the "When" and has much to do with the policy in place within the corporate environment.  Modern "Acceptable Use Policy" may spell out that any device can be examined at any time, if it is a corporate issued and owned product.  Personal devices allowed in the workplace may be subject to a completely different set of policy doctrine, that falls under state and federal statutes.

The "When" question could be on a continuous basis and tied to a particular event, such as an employee who has given notice to leave the organization.  The event could also be as a result of an alarm or alert that the Information Security team receives from an automated system, within the corporate network.  So back to the challenges faced by the CISO vs. the GC on the Operational Risk Management process and addressing all of these issues.  Is it a legally sound manner that also achieves a "Defensible Standard of Care?"
Now imagine all of this going on oblivious to the confines of a small-to-medium size enterprise (SME). These organizations are typically defined as under 1000 employees yet can be defined further by the type of business and industry.  Now imagine that this particular SME, is operating within the Defense Industrial Base and is in the professional services supply chain of the top three U.S. government contractors, who are bidding on the next generation bomber for the U.S. Air Force.  What do we mean by supply chain?  This particular SME, is one of the outside counsel for Lockheed Martin, Boeing or Northrop. Yes, this law firm is in the information supply chain, working on legal matters associated with a top tier defense contractor.
If you are the GC and CISO at LM, Boeing or Northrop, what controls and policies do you have in place or service level agreements (SLA) that spell out the process to forensically examine the mobile devices of the lawyers and associates of your outside counsel? When?  Why?  The public disclosure of law firms and their associates being the target of nation states espionage is several years old.  When was the last time as a GC or CISO you had a closed door summit with the information supply chain of law firms working for your Defense Industrial Base (DIB) corporation in the U.S.?  If you are a SME law firm, working in the supply chain of the DIB, What, Why and When are you using Forensic Analysis with all of your Partners, Associates, Paralegals and other people in your legal ecosystem?

Operational Risk Management (ORM) spans every department and every employee.  It requires prudent application of the use of forensic analysis, as a vital component of a comprehensive counterintelligence program.  And remember the why.  Spear Phishing of law firms has been a major warning since 2009 and over six years later, it is still growing because it remains so effective.

Stuxnet: Digital Sabotage of Critical Infrastructure...

The Chief Information Security Officer's (CISO) are getting significant new understanding of the new threat emerging in the digital domains. The Energy, Chemical, Water, Transportation and other Critical Infrastructure sectors are on high alert. The Operational Risks associated with their Programmable Logic Controller (PLC) systems using Siemens technologies are being attacked. Stuxnet is a new worm that has emerged over the past few months and is being analyzed from several vectors. One analysis that is forthcoming is who developed this new sophisticated industrial sabotage cyber weapon? Let's consider this logic from Ralph Langner:

Many aspects of Stuxnet are so completely different from malware as we know it that it's only natural that so many hard-working experts at some point in the analysis ended in frustration. The best way to approach Stuxnet is not to think of it as a piece of malware like Sasser or Zotob, but to think of it as part of an operation -- operation myrtus. Operation myrtus can be broken down into three major stages: Preparation, infiltration, and execution.
Stage 1, preparation:
- Assemble team, consisting of multiple units (intel, covert ops, exploit writers, process engineers, control system engineers, product specialists, military liaison)
- Assemble development & test lab, including process model
- Do intel on target specifics, including identification of key people for initial infiltration
- Steal digital certificates

Stage 2, infiltration:
- Initial infiltration using USB sticks, perhaps using contractor's comprised web presence
- Weapon spreads locally via USB stick sharing, shared folders, printer spoolers
- Contact to command & control servers for updates, and for evidence of compromise
- Update local peers by using embedded peer-to-peer networking
- shut down CC servers

Stage 3, execution:
- Check controller configuration
- Identify individual target controllers
- Load rogue ladder logic
- Hide rogue ladder logic from control system engineers
- Check PROCESS condition
- Activate attack sequence

For the CISO and executives who are sitting around the latest emergency CISCO Telepresence call at companies such as Entergy, American Electric Power, Dominion Resources and dozens of others in the power grid industry; the reliability factor is uncertain.

If this new malware had an initial project budget cost of seven figures $,$$$,$$$.00 to achieve the three stages described previously, preparation, infiltration, and execution then the price will soon be more affordable. A price for a malware exploit kit such as this one as it is reengineered for other purposes or types of targets will decrease dramatically as it propagates across the Internet.

The significance of the decrease in price is that now it will be more affordable for the transnational economic crime syndicates. How they will utilize the new Stuxnet capability in their toolkit for cyber extortion, digital sabotage and other schemes remains to be seen. What is certain is that it will not be long before this becomes a reality. Gary McGraw comments further:

Stuxnet is a fascinating study in the future of malware. Not only did it reveal at least 4 0days (which are still being patched by Microsoft), it clearly demonstrated that physical process control systems of the sort that control power plants and safety-critical industrial processes are ripe for compromise.

Now that the genie is out of the bottle, it is hardly possible to stuff it back in. Expect the techniques and concepts seen in Stuxnet to be copied. Attacks on process control systems are no longer the fantasies of paranoids in tinfoil hats — they are here.


The next Operational Risk that will be on the horizon are the plaintiff law suits, each time we have an event like this one:


Pacific Gas and Electric Co. on Monday announced it would put as much as $100 million towards rebuilding areas of the Crestmoor neighborhood destroyed in the flames. PG&E president Chris Johns maintained that money in that relief fund would be spent on reconstructing the San Bruno neighborhood, not paying off potential legal claims. Nonetheless, the utility company reportedly already cut the city a $3 million check to cover expenses associated with responding to the disaster. PG&E is also expected to pay victims whose homes were destroyed up to $50,000 to help pay for their everyday necessities. “I realize money can’t return lives. It can’t heal scars, it can’t replace memories… But there does come a time for healing and for rebuilding, and we are committed to helping that happen,” Johns added.

A full probe would be required to determine what might have caused the 30-inch high-pressure gas pipeline to burst at Earl Avenue and Glenview Drive around 6:15 p.m. that Thursday evening. Thirty-seven homes were apparently leveled in the blast. A 30-foot-wide crater could also be seen in the aftermath of the explosion. Authorities evacuated over 100 people in the area immediately after the blast. Now the California Public Utilities Commission has ordered PG&E to check all high-pressure gas lines located in densely populated areas. The National Transportation Safety Board (NTSB) is leading the investigation into the fatal San Bruno natural gas explosion.


It is too early to determine the exact nature of the cause of the San Bruno, CA disaster yet the corporate general counsel's of major utilities are preparing for their defense. The legal risks could go well beyond the exact scene of the explosion. Why? As the plaintiffs examine the number of PLC and SCADA controllers involved in the area of the incident, you can be certain they will be looking at the software systems associated with them. They will be requesting the Information Technology organization at PG&E to produce evidence of their policies, procedures, and best practices as it pertains to SCADA exploits such as the Stuxnet worm.

Managing the Operational Risks associated with the Energy and Chemical "Critical Infrastructure" sectors goes well beyond the norm of security and safety. Even BP has established a new Operational Risk initiative in the aftermath of their Gulf of Mexico catastrophe.

BP is to create a new safety division with sweeping powers to oversee and audit the company’s operations around the world.

The Safety & Operational Risk function will have authority to intervene in all aspects of BP’s technical activities.

It will have its own expert staff embedded in BP’s operating units, including exploration projects and refineries. It will be responsible for ensuring that all operations are carried out to common standards, and for auditing compliance with those standards.

The powerful new organisation is designed to strengthen safety and risk management across the BP group. It will be headed by Mark Bly and report directly to incoming chief executive Bob Dudley.

The company said the decision to establish the new function follows the Deepwater Horizon accident in the Gulf of Mexico and BP’s investigation into the disaster. It is one of a number of major changes announced by Dudley as he prepares to take over his new role on October 1.

Legal Risk: Forensic Intel for Investigations...

A wide spectrum of Operational Risk incidents are in the news. Legal Risk: Early Case Assessment...

After a few days at LegalTech New York this week, it's now confirmed that a very small percentage of small to medium enterprises (SME) are truly ready for the Operational Risk of litigation. How can a General Counsel achieve a defensible standard of care in this vast sea of software, technology and vendors that are trying to address the modern day business problem called "Electronic Stored Information?" (ESI)

Yet the likes of Bank of America and the Attorney General of New York are well aware of the importance of the "Meet-and-Confer" process as the allegations of fraud look for the "Digital Smoking Gun". Let the metadata wars begin:

Legal action has begun against Bank of America and its former bosses, accusing them of duping investors and taxpayers during the takeover of Merrill Lynch.

The defendants are accused of intentionally withholding details of huge losses Merrill was suffering.

New York state officials have filed the action against the bank, former chief executive Kenneth Lewis and former chief financial officer Joseph Price.


Principle 12 to the Sedona Principles states: Absent party agreement or court order specifying the form or forms of production, production should be made in the form or forms in which the information is ordinarily maintained or in a reasonably usable form, taking into account the need to produce reasonably accessible metadata that will enable the receiving party to have the same ability to access, search, and display the information as the producing party where appropriate or necessary in light of the nature of the information and the needs of the case. The issues faced by legal counsel at large Fortune 50 organizations are no different with the Small to Medium Enterprise when it comes to the "Meet-and-Confer." Making the decisions on what is relevant and the scope of eDiscovery is increasingly about the economics of litigation. Law firms are trying to reduce their costs and impact of billable hours with their clients and General Counsels are making sure that internal IT records management tasks are a top priority.

What many vendors are advocating in process and tools at LegalTech is the idea of Early Case Assessment (ECA). In other words, the Plaintiff is going to have to show their hand early and without slight of hand. These interviews with the Hon. James Holderman explains:

Editor: Doesn't that pretty much move in the direction of requiring the plaintiff to provide specific facts about the basis for the complaint? How can the discoverable "ESI" to be preserved and produced be determined unless the plaintiff comes forward with the specific facts on which its case is based?

Holderman: It cannot be done, and that is why the plaintiff needs to cooperate by divulging that information at the outset. Hiding the ball is a concept from the last century that can't be a part of present-day litigation. This is reflected in the Supreme Court's decisions in Iqbal and Twombly . Discovery is expensive and let's get the information out early. What is the benefit of bare-bones pleadings when the expense of e-discovery is so great? If the plaintiff has information then let's see whether the plaintiff has a sufficient basis for going forward to withstand a motion for summary judgment.


Where is the information you seek? In more places than you may realize as the investigation, forensics collection and rules of evidence are engaged. The risk of sanctions is real. The analysis of custodians Blackberry e-mails, BBM's and just plain text messages will be overwhelming as the Attorney General builds the case for fraud. The US Treasury, Federal Reserve and other government agencies will also be producing Terabytes of data for inquiry.

Regardless of the General Counsel's approaches at Bank of America or Merrill, the key risk items that they should have been addressing long before this trial with outside counsel are some of the following topics, again from LegalTech:

  • Cloud-based email and records management provides a new approach for cost-effectively managing law firm content
  • Securely archive information assets and maintain compliance with all regulatory standards, including the FRCP

Intelligence-led Investigations: DecisionAdvantage...

Operational Risk incidents are surrounding us on a global basis. The continuity of operations in the rescue and relief efforts in Haiti. The security of information and Internet politics with Google and 30+ other companies. A growing AQAP threat after Ft. Hood and NW 253 while Islam converts flock from US prisons to Yemen to drink the "Shariah" Kool-aide. When does information that is collected become a violation of a persons privacy or legal rights? At the point it is collected from a source or at the point in time when it is analyzed by a human?

Intelligence-led investigations include the use of automated Internet Bots to troll the Internet and Open Source content (OSINT) for the collectors to find what they are looking for. This begins with a hypothesis and then the development of an algorithm to carry out the automated mechanism for collection.

These Intelligence-led investigations also include the use of new forensically sound methods and proven procedures for collection of digital data from a myriad of technology platforms including laptops, PDA's and cell phones. These methods have been proven and certified in the forensic sciences for decades and follow many of the legally bound and court tested rules associated with evidence collection, preservation and presentation. Digital Forensic tools and 21st century capabilities enable global enterprises, law enforcement and governments to not only discover what they are looking for but to use this in a court of law to find the truth.

The monitoring and collection of information associated with people begins various intersections with the context, relevance and legality of storing it, analyzing it and when to destroy it. The ability to do this effectively inside the walls of the global enterprise corporate headquarters, the Regional Fusion Center or the National Counterterrorism Center (NCTC) is at stake.

DecisionAdvantage is a term that promotes the connotation of competition, safety or defeating an adversary but only one will apply as you begin to understand the environment and the circumstances under which information is being utilized for one or the other. If you are making decisions on the most safe and ideal drop points for water, food and medical triage supplies in Haiti, decisions are being made with information collected from satellites, humans, and the national geological scientists at CalTech. It isn't until you take all of these elements into context and establish relevancy with human brainpower can you make an informed decision to give you an advantage of improved safety and security to achieve your goal.

Investigators or analysts who are leveraging the use of software, hardware and telecommunications infrastructure to more efficiently arrive at the answers of the hard hypothesis or questions being asked must improve their training, education and awareness to the associated human factors. Predicting human behavior is difficult if not impossible. What is more realistic is the utilization of automated systems to assist the human in trying to achieve a DecisionAdvantage. Proving the ground truth is a challenge in a court of law, in front of a jury and so too when it comes to declaring a cyber attack from another nation state. According to Jeffrey Carr and his Grey Goose Project, here is why:

When sensitive or classified data faces cyber attack, why can’t governments – or organisations – identify the culprits with any conclusivity?

A state cannot respond to concerted assaults by hackers with anything more potent than a diplomatic protest – which will be met with a firm denial by the accused government or body. There isn’t even agreement on what constitutes “cyber warfare”. As an expert in cyber warfare intelligence, I have researched the legal complexities and multiple strains of conflict, with the aim of trying to identify which acts qualify as cyber war.

What is undeniable is that politically-motivated attacks are becoming more frequent and sustained. Amazingly, none of the assaults on security shown (right), all of which have occurred in the last 18 months, qualify as an act of “cyber war”. The only issue that has been defined by international agreement is a nation’s right to self-defence when attacked, which, for the moment at least, applies only to the traditional manner of attack, ie, “armed” attack. From some adversaries’ point of view, this makes the internet an ideal battleground.

The eight events described opposite have all been characterized by various media sources as acts of cyber war. But definitive “attribution” – the smoking gun – was rarely achieved. The problem is that the internet was not built to be a secure platform. Its architecture inherently supports anonymity. As a result, a purely technical analysis of cyber attacks has almost never been successful at producing definitive proof, the cyber equivalent of DNA evidence.

For 18 months I and my colleagues in the Grey Goose Project have investigated Russian cyber attacks on Georgia in 2008, and we believe governments must adopt a new method of determining attribution, taking into account the policy of a state, regional events and intelligence. In addition, we apply the tried and trusted criminal investigation test of means, motive, and opportunity. I hope the attack on Google and its inevitable departure from China’s internet will trigger a broader awakening about the need to define what we call cyber warfare.

Legal Doctrine: Intelligence - led Threat Assessment...

Corporate Threat Assessment is gaining new momentum as "Operational Risk Management" professionals utilize new business processes and tools to preempt human malfeasance. Whether it is the disgruntled employee who has just been separated from the company or the college student who acts against his math teacher for grades; the question remains: How could this have been prevented?
The Washington Post reports:

A disgruntled 20-year-old student walked into a classroom at the Northern Virginia Community College campus in Woodbridge on Tuesday afternoon and fired at least two shots from a high-powered rifle at his math teacher, authorities said.

The teacher saw the gun, yelled for her 25 students to duck and then hit the floor.

"We heard a boom," one of the students said later. "I thought to myself, did a computer explode?"

The student's shots missed. He put the gun down, sat on a chair in a fourth-floor hallway and calmly waited for police.

Jason M. Hamilton of Baneberry Circle in the Manassas area was charged with attempted murder and discharging a firearm in school zone. He was being held without bail, and police officers said they wanted to question him about a motive.

The legal machine is at work to determine the multitude of reasons why this incident occurred and to collect the evidence in the case. The investigation into "Who Knew What When" will be spinning up almost simultaneously as the plaintiff lawyers determine what opportunities might exist for a law suit. Several areas of questioning for Northern Virginia Community College (NOVA) will include:

1. What evidence is there of a Duty to Care: Did NOVA provide training for professors to alert an internal "Threat Assessment Team" whenever they witnessed or found evidence of specific pre-incident indicators?

2. What evidence is there of a Duty to Warn: Did NOVA warn fellow employees to keep an eye out for any students carrying long slender bags into campus buildings or to monitor parking lots for suspicious activity?

3. What evidence is there of a Duty to Act: Did NOVA provide notice to security employees on the student who was absent during the term for over three weeks ?

4. What evidence is there of a Duty to Supervise: Did NOVA professors report any strange behavior, statements, or even the fact that the student had been absent almost a month?

Human behavioral studies regarding workplace safety suggest, that one in five people come to the institution every day with a serious problem going on in their personal life. This has a dramatic effect not only on workplace performance but also the potential for bad behavior. This bad behavior could be acted out physically or quietly and in stealth mode. In either case, the company, it's employees and the reputation of the institution are at stake. What is your Corporate Threat Assessment Team working on today to preempt the next incident?

As the investigators evaluate the digital evidence in the case such as e-mails, Facebook Wall postings or other information found on a PDA, laptop or home computer the "Smoking Gun" may be uncovered. And when it becomes public, the game changing events will begin to unfold. Many companies feel that having a formal internal "Threat Assessment Team" sends the wrong message to the employees that "Big Brother" is watching. This could not be further from the true state of mind by many employees today. Knowing that a team is proactively addressing the one in five employees everyday in the workplace should provide more peace of mind than the thought of an invasion of privacy.

So what are the typical channels that an employee will use to communicate their grievance or threat?

If this trend continues then over half of the communicated threat will be via a digitally based medium. What is your organization doing today to monitor communications for specific threats to your employees, suppliers or partners? The modification of Acceptable Use Policy and the other legal policy regarding the workplace monitoring of e-mail is not a new phenomenon in many organizations, notably those in the Defense Industrial Base (DIB.)

Recent changes in the privacy settings of Facebook makes much of the information placed in these 350 million profiles public information and therefore, capable of being viewed and analyzed by a proactive threat management team. Here is the analysis from the EFF:

The Ugly: Information That You Used to Control Is Now Treated as "Publicly Available," and You Can't Opt Out of The "Sharing" of Your Information with Facebook Apps

Looking even closer at the new Facebook privacy changes, things get downright ugly when it comes to controlling who gets to see personal information such as your list of friends. Under the new regime, Facebook treats that information — along with your name, profile picture, current city, gender, networks, and the pages that you are a "fan" of — as "publicly available information" or "PAI." Before, users were allowed to restrict access to much of that information. Now, however, those privacy options have been eliminated. For example, although you used to have the ability to prevent everyone but your friends from seeing your friends list, that old privacy setting — shown below — has now been removed completely from the privacy settings page.


There are legal cases pending and there will be more to come about whether the mining of public data for profiling people is against the law. In most cases, it will be dependent on who is doing the collecting and for what reasons. Yet the most sophisticated systems for doing analytics or the latest matrix or mosaic methodology will not be able to provide a fail safe for the corporate enterprise. This is precisely why the earlier mentioned employer "Duties" are so vital to day to day operational risk management. The actions you take before, during and after an incident will be the most vital to your legal and reputations survival.

TWO computer programmers who worked for convicted fraudster Bernie Madoff were charged with bribery by the US Securities and Exchange Commission today.

Jerome O'Hara and George Perez allegedly took bribes to create false documents and trading records for Bernard L Madoff Investment Securities LLC for more than 15 years, according to the SEC's complaint.

"Without the help of O'Hara and Perez, the Madoff fraud would not have been possible," George S Canellos, director of the SEC's New York regional office, said.

"They used their special computer skills to create sophisticated, credible and entirely phony trading records that were critical to the success of Madoff's scheme for so many years."

Operational Risk Management requires a vigilance of monitoring digital information inside and outside the workplace. Those institutions who combine the correct legal doctrine, business processes and technology will prevail in the vast chaos of litigation and human threats within the workplace.

Remote Digital Forensics: Complacency Risk...

Operational Risk Management commands a spectrum of disciplines within the global corporate enterprise. While convergence of responsibility, accountability and resources is taking place the internal threats continue to flourish. Why? How could a Chief Security Officer (CSO) not be aware of a specific threat to the institution by unknown subjects half way around the world? The transnational organized crime syndicates that target our weakest organizations know that they don't share information between departments, business units or even shared services within the enterprise. Does your CSO get a briefing from the CISO or CIO / INFOSEC staff on what the latest threats mean to you, such as cyber heists using ACH fraud?

This complacency is an internal threat that continues to amaze many and reinforces what few people truly understand about risk management. The adversaries utilize asymmetric strategy against unsophisticated targets to perpetuate their crimes and overall threats to people, processes, systems and deposit accounts. They are the modern day equivalents of "Bonnie & Clyde", Al Capone with a dash of Al Gonzales all rolled up into a massive threat that is increasing exponentially:

Two Romanian Citizens Extradited to the United States to Face Charges Related to Alleged Phishing Scheme

A phishing scheme uses the Internet to target large numbers of unwary individuals, using fraud and deceit to obtain private personal and financial information such as names, addresses, bank account numbers, credit card numbers, and Social Security numbers. Phishing schemes often work by sending out large numbers of counterfeit e-mail messages, which are made to appear as if they originated from legitimate banks, financial institutions, or other companies.

The investigation leading to the indictment stemmed from a citizen’s complaint concerning a fraudulent e-mail message made to appear as if it originated from Connecticut-based People’s Bank. In fact, the e-mail message directed victims to a computer in Minnesota that had been compromised, or “hacked,” and used to host a counterfeit People’s Bank Internet site. During the course of the investigation, it was determined that the defendants had allegedly engaged in similar phishing schemes against many other financial institutions and companies, including Citibank, Capital One, JPMorgan Chase & Co., Comerica Bank, Wells Fargo & Co., eBay, and PayPal.


Risk Management 101 talks to the X and Y axis with X representing the frequency of risk and Y representing the severity (impact) of the risk. So using the four quadrant model, the lower right box is where low risk times high frequency incidents occur. In the upper left box is where high risk times low frequency incidents occur. Got it.

As a CSO in your organization, where do you spend your time, resources and personnel in terms of their training, awareness and work efforts? Think about it for a minute. Most of you would probably say, "Well we focus on the High Frequency times High Risk incidents, the upper right box of the Risk Management model." Practice and prepare for the incidents that happen often and you will have employees who have no clue on what to do the day that something from that upper left box impacts your organization. The HIGH RISK x LOW FREQUENCY incidents are where you remain most vulnerable.

Arlington Man Sentenced 36 Months for $40 Million Ponzi Scheme

ALEXANDRIA, VA—Preston David Pinkett II, age 70, of Arlington, Va., was sentenced to 36 months in prison for engaging in a massive Ponzi scheme that raised more than $40 million in fraudulent payments from investors. Pinkett was also sentenced to three years of supervised release and ordered to pay $18,774,989 in restitution.


The two years that most frauds are conducted before they are discovered tells most risk managers that even effective accounting and audit controls can't catch these white collar criminals before it's too late. The high risk low frequency incidents are the greatest impact on your institution and yet little or no resources, training or attention is paid to these threats to your reputation and economic livelihood.

Now let's take this step further into what practices you have with exiting employees from your business. Are you conducting exit interviews? Are you examining all of the employee's digital assets for the presence of anti-forensics or the ex-filtration or theft of sensitive, proprietary trade secrets or intellectual property from the corporation? Both of these steps are necessary regardless of the person leaving and the circumstances why they are leaving your institution.

The utilization of "Remote Digital Forensics" and other centralized shared services such as this can provide your Business Units and even suppliers with capabilities that they don't need to staff internally. The technologies and resources exist today to address the stealth of fraud, the crisis stemming from industrial espionage or the disgruntled employee stalking those who they perceive as the reason for their dismissal.

An effective internal approach to high tech and advanced Operational Risk Management as it pertains to the rapidly changing landscape of smart, educated and daring people shall include a robust intelligence and audit capacity. Without it, the transnational eCrime syndicates or the internal employee threat will prey on your vulnerabilities of complacency, lack of training and apathetic approach to the design, configuration or implementation of your systems.

FCPA: Modern Day "Smoking Gun"...

Corporate malfeasance is on the mind of most global executives today. Their enterprise is consistently fighting the economic challenges and at the same time defending it's reputation as new "Smoking Guns" are revealed. Perhaps these modern day discoveries of wrong doing should be renamed "Smoking Digital Evidence" because this is exactly what it is. Information uncovered through normal monitoring practices or as the result of a specific investigation produces "Red Flag" alerts based upon acceptable use policy or corporate rule sets.

These "Red Flags" uncovered in the context of programs devoted to processing digital evidence is now a standard Modus Operandi for corporate governance, legal and operations risk management. These new tactical business units are being developed in a rapid response to new regulatory and compliance mandates yet the greater pressure is coming from the wake-up calls senior executives have been receiving lately.

The Justice Department's probe of the credit default swaps market is reportedly focusing on Markit Group Holdings Ltd., the London-based supplier of prices in OTC derivatives, and its relationship to a group of major banks that own a stake in the company. The DOJ is scrutinizing the ownership of Markit by a group of banks that control a large amount of pricing in the $28 trillion credit derivatives market.

The banks have received a notice of investigation from the DOJ asking them for details on their trading activity, including how much they have at risk in the market and their monthly value of their credit default swaps, according to Bloomberg News. Banks that own the largest stakes in Markit, include: J.P. Morgan, Bank of America (through its acquisition of Merrill Lynch), Deutsche Bank, Royal Bank of Scotland which acquired ABN Amro, as well as Credit Suisse, Goldman Sachs, Morgan Stanley and UBS, according to Bloomberg News.

"The DOJ is looking to find any wrongdoing in that marketplace," commented Paul Zubulake, senior analyst at Aite Group in an interview with Wall Street & Technology. "Obviously that is going to open up a large can of worms," he said. "It will be costly for the dealers that have to battle the DOJ given the discovery issues, about all the information, emails and instant messages they will need to turn over."

Digital Forensics, Records Management and eDiscovery units at some of the largest financial institutions are working overtime. Finding any "Smoking Digital Evidence" will be the standard operating procedure on most international transactions whether it be in the financial services industry or even telecommunications:

Good news for compliance officers: You now have solid evidence that the benefit of implementing an effective compliance program far outweighs the cost, in the form of the massive Foreign Corrupt Practices Act settlements swallowed by Siemens AG and three of its foreign subsidiaries.

Siemens, a German conglomerate that is one of the largest engineering firms in the world, agreed in December to pay more than $1.6 billion to U.S. and German regulators for a massive bribery scheme that felled the highest executives at the company. Penalties paid to the Justice Department and Securities and Exchange Commission alone topped $800 million, by far the largest sanction ever imposed in an FCPA case.

In the following excerpt, Linda Chatman Thomsen speaks on the massive Siemens investigation: "Furthermore, the $1.6 billion total that Siemens will pay in these settlements is the largest amount that any company has ever paid to resolve corruption-related charges.

And that is fitting because the alleged conduct by Siemens was egregious and brazen. It was systematic, it involved thousands of payments, and it occurred over an extensive six-year period. Siemens created elaborate payment schemes to conceal these corrupt payments to foreign officials. The company’s inadequate internal controls allowed the conduct to flourish.

The details tell a very unsavory story: employees obtained large amounts of cash for Siemens’ cash desks; employees sometimes carried that cash in suitcases across international borders to pay bribes; payment authorizations were recorded on post-it notes that were later removed to avoid leaving any permanent record; there were slush funds and a cadre of consultants and intermediaries to facilitate paying the bribes.

Investigating this intricate scheme and righting Siemens’ wrongs has taken a remarkable and unprecedented level of coordination among many law enforcement agencies around the world."

The internal threat of employees, partners and so called in-country agents who help facilitate business deals is one square in the risk management matrix. The business transactions themselves are becoming part of the Venn Diagram that includes:

  • Business & Global Commerce
  • Personnel Security & Integrity
  • Rule of Law & Litigation
As global institutions continue their expansion across the continents where capital follows security and the rule of law, so too will the attacks on the corporate enterprise.

Digital Forensics: Right to Question CSI's...

The US Supreme Courts ruling in MELENDEZ-DIAZ v. MASSACHUSETTS will have significant impact on Digital Forensics expert practitioners. Legal cases utilizing the examination of computers and other digital assets containing relevant information will have more testimony by CSI analyst experts. The New York Times report by Adam Liptak says:

Crime laboratory reports may not be used against criminal defendants at trial unless the analysts responsible for creating them give testimony and subject themselves to cross-examination, the Supreme Court ruled Thursday in a 5-to-4 decision.

Noting that 500 employees of the Federal Bureau of Investigation laboratory in Quantico, Va., conduct more than a million scientific tests each year, Justice Kennedy wrote, “The court’s decision means that before any of those million tests reaches a jury, at least one of the laboratory’s analysts must board a plane, find his or her way to an unfamiliar courthouse and sit there waiting to read aloud notes made months ago.”

The outcome of the ruling for the prosecution is that forensic examiners and scientists will be more thoroughly scrutinized in the tests they perform. The process will require more effective documentation and the ability to play back for a jury exactly the process utilized to support any facts of evidence. This will not be difficult as Best Practices today are being utilized such as the video taping of the entire test and examination. Achieving a "Defensible Standard of Care" will however be even more of a priority for Operational Risk Management professionals.

The defendant will have the ability to cross-examine the analyst, whether it was making a determination on what the blood type was of the accused attacker or the date, time, and place that the defendant sent an e-mail from the office computer to a co-conspirator.

In the digital forensics environment, the ruling means that the subject matter experts will simply be spending more time in court and on the witness stand. This will impact the time it takes to conduct the trial yet the rights to examine the process, expertise and documented procedures for the evidence that has been introduced is an important issue.

From an Operational Risk Management point of view, this means that your eDiscovery and Digital Forensics certified examiners will be under the magnifying glass and subject to the questioning by counsel. We see an increased attention related in civil matters coming soon. Several states are asking that the outsourced entities associated with inspection of digital assets be licensed by the state itself, as a Private Investigator. This provision would subject the expert authority to also being legally certified in the knowledge of state laws pertaining to civil procedure, chain of custody and legal procedures on the handling of evidence.

The question remains on whether the Supreme Court Justice's were thinking beyond the test for the presence of a drug, as this case was focused on in MELENDEZ-DIAZ v. MASSACHUSETTS. The defense bar will be utilizing this ruling to go beyond the criminal courts to the civil trials where white collar cases are largely based upon the documents, e-mails and other digital evidence that has been retrieved using forensic procedures.

It will be interesting to see how this ruling impacts the professional licensing, certifications and documentation of examinations for the 21st century Digital Forensic "CSI".
